The Netherland: PhD Position at The Institute for Information Law


This doctoral (PhD) research project will preferably focus on one of the following topics:
a. The history, rationale and possible future of the prohibition on copyright formalities (Art. 5.2 of the Berne Convention), considering (1) the increasing need for rights management information (metadata) to facilitate electronic commerce in copyrighted works, and (2) the public interest in having works that are not commercially exploited enter the public domain.
b. The internal consistency of the statutory system of intellectual property law (copyright, patents, trademark and design law), in particular the internal consistency of statutory limitations, especially in domains where intellectual property rights may overlap and apply cumulatively to a single object (e.g. industrial design, computer software, databases).
c. The history, rationale and future of private copying exemptions, particularly in the light of emerging digital rights management systems.

Candidates are advised to familiarize themselves with the Institute’s research programme, which can be found at www.ivir.nl. Candidates are not expected to submit a detailed research proposal, but are invited to reflect, in their letter of application, upon one or more of the topics mentioned above. Other topics that fall within the field of international copyright law may also be considered.

Requirements
• Active and passive knowledge of the English language
• Good, or at least passive knowledge, of the German and/or French language
• Thorough knowledge of copyright law
• Relevant research experience is desirable but not mandatory.

Appointment
The appointment will be for four years, and is expected to lead to a PhD degree. The gross monthly salary will be € 1,867, rising to € 2,394 in the final year. Although the position is offered as a full-time appointment, a part-time appointment for five years (32 hours per week) may be negotiated. Training and supervision plans setting out the research and teaching obligations will be agreed upon with the successful candidate.
